Rear ended 70 miles an hour on highway

Glad you're okay.

Important thing I'd suggest- make sure you take it to a body shop that the insurance company suggests. That way if the work ever causes problems you can throw it back at the insurance company. Otherwise, they'll say you chose the shop and its your problem.

Okay let's say this there were no skid marks and I had glass in my hair I was wearing a hat and my sunglasses were in the cargo area he was going at a high rate of speed and my new truck is &@#%~] up I was slowing down because I was coming to stop he was not paying attention or on the phone not sure I wasn't there but the impact was hard no lights grille bumper left on the F150 fluid on the ground and deployed airbags I am not an accident reconstruction expert but I do know he was going faster than 30mph ....better ?

Glad you are ok, OP.
I don't think anyone is trying to downplay the collision, only determine how significant the damage may be (which was your initial question). To do so, the key is not his speed, but the difference in his speed and your speed.

How fast do you estimate he was going?
How fast do you estimate you were going?
Subtract your speed from his speed and that tells you the difference in your speed.

How fast he was going compared to a stationary object is not the key point since you were not stationary. If you were slowing to a stop and were at 40 mph and he was still going 70 mph, he was only 30 mph faster than you. 30 mph is not a small bump, but it is also a lot different than a 70 mph collision.

Re

Thanks everyone for your help and comments I know a few people said it doesn't look bad I agree and I am thankful I walked away the 4Runner is a well built vehicle I had a 2001 before this one and loved that as well my problem is I want to be like I was at 7:05am on December 15th because I was not at fault for the damage to my vehicle and now I have some excellent information thanks to you guys that I can use to make me "whole" again

Thank you !!

Oh no I understand just trying to explain it a little better I was going maybe 10 to 15 mph at best he was going I would say 55-60 or so when I looked up he was coming at me fast the state trooper said 70 I have no idea how fast he was actually going but it sent me across the highway pretty quick my foot was on the brake but when he hit my foot came off the brake ...first accident and not fun as you all know

Sort of in the same boat..knocking on wood it will be totaled because I'm putting a DP on a new T4R, and not looking forward to selling it if they dont. I was t-boned then flipped onto the drivers side both curtain airbags deployed etc..

bets on if it will be totaled?

Its not a terrible thing to see an accident on a car fax. As long as the repair work is done properly the car is just as good as any other vehicle. If the frame is bent then the insurance company would certainly total out the vehicle most cases anyway. I just purchased an Acura TSX that had like 3 front end collisions reported as minor accidents. I couldn't tell what had been replaced, repainted, or damaged. Even took the front clip off to investigate couldn't tell a darn thing other an the front grill had a bolt hole cracked not securing properly. The car runs and drives great.. Its more a stigma thing "oh god this cars been wrecked I can't own a wrecked vehicle"..... a 4runner's a 4runner..

BUT I am willing to bet you used these accidents to help negotiate a better price or got a better deal than if it had never been in 3 accidents. Otherwise, why not buy one that had never been in an accident if the prices are basically the same? Just my thoughts...

Rear frame section is bent. That black bar IS the end of the frame and it is bent upwards.

Also remember, when that rear frame member is bent/pushed forward, it also pulls the sides of the frame in with it. So, you need to be comfortable knowing that even though the rear frame cross member gets replaced, that the larger main sides of the frame were yielded and may be rebent back out to be parallel with each other during the repair.

I would assume the same thing but in my case I didn't. The repair work was spot on and I would have never known had I not looked at the car fax. My bank valued the vehicle at the same price as any other 09 TSX on the market, so the market value is what I paid. Again, its a stigma.

Either way, glad no one was hurt and hope this gets clear up for the OP

There is always a stigma to cars that have been in an accident, whether you own it or are shopping. I was hit by a drunk driver once in a Mini Countryman. Insurance adjuster initially tried to claim it could be fixed, but a second opinion by a body shop of my choice got the car totaled.

I didn't want to deal with the diminished value process, nor did I want to try and sell a vehicle down the road that had been in a wreck (market shrinks real quick). I never buy vehicles with dings on the Carfax when the internet has opened up so many more opportunities to shop; just a mental stigma of what could be lurking.

My 2 cents.

As others have said, you absolutely have to go after a diminished value claim on this. I just got mine back and on a $1700 (small sideswipe) repair and my diminished value came out to be around $1200. If the frame is bent, the value of your vehicle has dropped significantly. Use a reputable site to help you recover the loss. The other drivers insurance will fight you tooth and nail, but the reality is simple: even if the body shop can restore it to the way it was, it will never be worth what it was before the accident (this can be as much as 30% or more). Don't let the insurance company try to offer you some bs like $500 to cover that. Just to give you an idea, the body shop had to replace my rear bumper cover, as well as reset the rear driver side fender, paint and blend to match. The rear fenders are part of a single piece that goes all the way to the front fender. The body shop had to remove my rack and fall of the parts that go with it just to fix the small amount of damage. Also, if they do decide to fix it, pick a shop that has very good reviews and one that you trust. It took the one that I wanted 2 months to get me in, but the results were totally worth the wait. Also, you drive a 4Runner, don't let the insurance company try to give you some sub-compact. They need to provide you with an "equivalent" vehicle.

okay here is the current situation on my 4Runner it is a total loss the frame is bent so now I am out a vehicle 9,000 down payment 20 days without a rental (I am in one now a Chevy cruze) and the insurance company says the truck is worth 30,700....how can they get away with this ?
not including medical bills which I have not yet received no money for a down payment on a new vehicle the old 4Runner was traded (the 2001) so I have nothing to get another vehicle with ....so this is what you get for doing the right thing I guess
Any lawyers out here ?

Did you get GAP insurance?

Sorry to hear things are not going well. Insurance is only going to pay you what the vehicle was worth on that day, not what you paid or what a new one would cost. Gap insurance will cover any difference if you are upside down on the loan. The value they are providing is fairly consistent but is negotiable, reference the trade in numbers here: 2011 Toyota 4Runner Utility 4D Limited 4WD Prices, Values & 4Runner Utility 4D Limited 4WD Price Specs | NADAguides

If you were hurt and have unpaid medical bills, as others have suggested please contact an attorney yesterday, it is time to escalate this.

Yes had gap insurance.... time to leave Massachusetts !!
actually I owe 31,632.86 on the truck going to have to make this months payment as well which does not leave much left over but damn what a bunch of *******s nine grand why should I eat that kind of money
