i see this now as a question of how far the builder is willing to go to stand behind his product, is he going to take the easy way out and make the customer eat the total loss by hiding behind clauses in the warranty or is the builder willing to take at least some of the responsibility here and do what he can to keep his costumer happy and get him back out on the road......
[I]so far what i'm seeing here is the builder is doing nothing more then he is legally obligated to[/I], and honestly i can't say i look favorably upon such a thing.

there's a big difference between what is right and what is legally obligated to.
we all know john keeps an eye on his truck and is competent, we know him.
if this guy wants to keep going about things like this instead of coming to a fair compromise for both parties that's his prerogative, nothing john or anybody else can do about it besides spread the word. legally he is living up to his end of the deal, which is fair enough, but not
RIGHT
we all know that john runs his scanguage and keeps an eye on things with far better resolution then most, so calling attention to the previous thread is an obvious smoke screen amongst the other technicalities just goes to show that he is about profit over service....which is fine too, those companies don't tend to last long......... we know he hangs out on yotatech now as well and i'm pretty sure he's a poster over in my VW forum "the samba" for engine builds as well, amongst a few other places where i think i heard that name before......
the word spreads fast, so keep the flaming to a minimum and just link everyone you know to this thread, and let them make up their mind, that's really the best thing you can do in this situation, i don't see much legal recourse happening and in the end even if john did win the guy is only out a few thousand tops, but calling him out on a public forum, taking the high road and exposing how the guy handles a botched job, which lets face it will happen to any and every engine builder from time to time, is going to cost him who knows how much in the long run $$$$$$$$, so making threats and just talking crap in general does no one any good, makes us look bad and people will focus on that instead of this guy fubar'ing a job and making the customer eat it because of technicalities and that new flat screen tv in his living room....which is what the case really is here.....
maybe we can all go over to johns house for another meet
and help sort this out for him, i got a few engine hoists we can use and infinite tools from work, maybe while we're in there we can check everything else out while we're at it and see what really happened....this really sucks john and i don't blame you for being pissed in anyway he cost you a fair amount of money and is only willing to deviate from his warranty enough to cover his ass and not cost him any money or time in the end... besides fixing what he fubar'd in the first place....
i'm all for small companies,guys working out of their garages and shacks, or whatever, in fact it is something you become quite used to after restoring and building more then a few classic imports , i get the warranties and clauses ect ect, he's gotta put food on the table and protect himself as well,but this isn't a typical case of some 16 yr kid buying an engine and trying to install it with the wall mart tool set his mommy bought for christmas
he paid to have it professionally installed and the install was right on the money......
IF it was my company...
the right thing todo :
have him drive up to your shop pull the motor for free
inspect the heads and block, figure out what happened
go from there....
if it was john's fault make him pay for both the removal and install.....
if it was your fault just make him pay for the install of the new motor at a discounted shop time fee.....but he still pays something....

is if it was johns fault you get paid for your time and labour for removal and install, he looks stupid, we all look stupid... your reputation as a engine builder is exemplified by what you do, and everyone leaves happy
if it was your fault, john learns his lesson on 3rd party installers, you still get paid, albeit not as much but it's still something, everyone here and everyone we ever come into contact with says "yeah that guy is worth going to if somethings not right he'll make it right" and you get more work from this forum and other forums us and everyone else who reads this and other forums we visit
there's not much for you too lose here really except a bunch of word of mouth customers if you do nothing.....
i'm not commenting further on the situation until there is some sort of resolution as it seems pretty clear where the builder stands on this and john is just screwed...:AK47:
