I have the clunk. it does not bother me.

I have the sulfur smell. I am going to TSB it with the dealer.

The positives are so superior on this vehicle that a clunk and a smell is almost acceptable.

I had a girlfriend. She kept nagging. NOW that I had to do something about. :)

I can understand your frustration, but me personally, to answer your question: No, I would not try to run the lemon law rally with these issues. Instead, if it really bothered me like it clearly bothers you, I would have my attorney contact Toyota corporate directly and have them do the proper TSB with the new cat's as prescribed for model years prior "which has a 50/50 sucess rate", I would also insist the GX470 TSB be done on my 4runner, or as close as possible "some suspension bushings are a little different", and I would simply accept the fact that all anything mobile rattles, including ole' Mother Earth, as evidenced by the earth quake last week in LA.

You won't win this though. Sure, they might offer to purchase the car back from you, for "fair market value", but you won't get dollar for dollar. Or, they may simply say "let's play ball, I've got an army of arguments against you". One, for instance, and I'm sure the Toyota attorney will clearly do, is simply come onto this forum and hit "print" on a few of these threads about these very common issues. Two, the problems you're stating for grounds of your lemon law, are only "problems" in your definition. In other's, they're simply described as Toyota characteristics, and clearly don't drive customers away, as clearly evidenced by Toyota being the #1 automobile maker in the world. Time and time again, through all automobile manufactures, there have always been, and will continue to always be, a handful of customers that simply realize 3,000 miles into ownership that they don't like their car anymore. How do you think MB owners feel over the past 8 years? How about BMW 325-38-30 owner feel when their subframe mounts tear loose in the back, costing thousands to repair. Or the Ford Exhibition owners who constantly deal with a leaking front differential seal, or Chevy owners with the parade of recalls every year? Simply put, your argument for enacting the lemon law will get shot down before it even hits the taxi way.

Lemon law is for "defects" beyond repair. Judging by the sales figures during the past 10 years for 4runners "birth of the clunk in 98'", and attempts by Toyota to address the sulfer with TSB's, I'd have to say these aren't defects, but rather characteristics. Furthermore, the sulfer smell is under heavy acceleration. Not normal acceleration, or at idle, which will ultimatly be tested in the case, and therefore your smell issue will deemed a characteristic of your driving style, not the car's normal operational style. Additionally, if you'd look on the brighter side of life, you'd realize that you have the ultimate weapon against tailgators.... Trust me, my 05' V8 stinks up too sometimes, and comes in VERY handy when some punk-ass-chump is riding my bumper. A little slip into "N", a couple quick revs to 5krpm, and back back back they go! I love it!

By the way, given your kind remarks about the "harmonic vibrations", I assume you KNOW what causes them, right? Well, do you? I do. I know exactly what causes them. I know they will never be fixed on the 4.7 V8 so long as they're built. Not yesterdays, and not tomorrows. But, do you?

I'll give you a hint: It has three letters, it's required on all "cars", but isn't for SUV's beyond a certain weight/design. And, it's very expensive to fix when it breaks......

Yes, your right, there are bigger things in life to worry about than a clunks and rattles...like, graduating highschool, finding that special someone, and knowing the difference between design flaws and harmonic vibrations. Honestly though, keep up on this forum, its full of good honest real life info.

A ****ing child can tell your not going to get a new car from the lemon law because of a clunk even if William ****ing Shakespeare himself wrote it.

Oh and by the way that mechanics treat cars with "limited" or xle badges is complete and utter BS.

The harmonic vibration is due to the v8 engine, I dont know the full detail but there is NO way to prevent it from the engine.
 
PS: I'm not 19, I'm 34, and I fire lawyers all the time for getting it wrong. Screwing up legal documents, taking too long, charging too much to our clients, and pure b/s platforms. Additionally, another family member of mine was part of the NC Bar team who took down ole' Mike Nifong....remember him? Google "Duke Lacross". So, I'd love to hear your platform on how you plan to corner Toyota under Ill's lemon law.

Know what R, O, L and D,E,A means in the accounting world, remember that saying, and you'll ace accounting. I did. I was a finance major, which in my opinion is one of the best degrees to get, for all career paths. Hey, everything needs to be paid for, no matter what it is. If you show up saying you know how to pay for stuff, you'll get a key to the building, and access to those inside. Doesn't matter if it's a community bank, or a major movie studio like MGM. Want to be a movie star? get a finance degree and get your butt on the lot, in the front office next to the power makers, who will come to you "and know you" because you're the guy makng the spreasheets. Same for accounting! Good choice!

For those who are still reading for things related to the 4 Runner I am taking mine in on Wednesday with a copy of the sulfur smell TSB thanks to this forum.

All the other he men. plllease this is a forum for 4 Runners not intended to compare the size of the your jock strap or your intelligence.

I would not have. None of them are hard fixes and certainly none of them denote a "lemon" vehicle. None of these problems affect performance or function. Certainly none of them are worth the legal cost. You would be spending more losing this case than either simply fixing the problem yourself or even outright selling the vehicle to buy something else.

Honestly, I think you're pulling our leg, being funny, stirring the pot, trolling, or something. Your over the top anger, profanity, racial insult, and condescension to people you don't know is befuddling. That's where you lost me. It's odd. Who else do you know that's gone to lawyers over a car's rattle?

These are reasons I think you're kidding with this whole thing.... or you're way out in left field. Of course some people start anonomyous forum fights because they enjoy it.

What are you expecting from a more expensive and luxurious brand and which? Land Rovers are a lot more expensive and they brake in seriously expensive ways. Hummers too. Mercedes and BMW suvs also don't fare nearly as well as Toyota in JD Power or Consumer Reports. Have you checked into the Highlander or Rav4. Of course they're still Toyota. How about the Honda Pilot? Maybe a car based crossover from a reliable brand on a unibody frame with front and rear IS and front wheel drive. That would eliminate a lot of moving parts that clunk and rattle and likely provide a smoother onroad feel.

What exactly are you looking for? Maybe other's on here who have done a lot of car searching themselves can point you in a better direction. I probably spent too much time researching for what suited me best and came up with the 4Runner, and again, I don't have the issues you're describing. The only other SUV I'd take over it is one of the better Land Cruiser models (or anything else a lot more expensive so I could sell it, get another 4Runner/LC and pocket the change ;): ).

If you are serious let us know how it goes and put up some kind of proof. It would be very interesting if you actually get it through. Odds in Vegas are heavily against.

I have an idea, just walk. If you so upset about a rattle here and clunk there walking eliminates all that.

Just makes sure when its cold, not to get a jacket that "swishes" a lot because you might try to sue the jacket manufacturer.

By the way, my mom, many years ago, lost a Lemon Law litigation with Volkswagon. Her '93 Fox had a chronic overheating problem, causing the head gasket to blow by 900 miles, and several other issues besides the fact the engine life was probably shortened. I think that's a dangerous situation (hello, a woman stranded somewhere!), but the judge didn't agree. My stepdad and I installed an oversized radiator, high capacity water pump, and a stronger fan motor to curb the problem for around $400.
Based on that, I wish you luck. Hopefully, your lawyer is a slick SOB because some smells and rattles do not compare to constant overheating IMO.

Im waiting for the thread saying that he is going to fire his lawyer because he found him on TV in one of those corny ads, paid him $5 and is now complaining that he isnt getting treated like a high-paying Baker & McKenzie client should be.

I think he's got some phone-book attorney who's talked him into filing a complaint, and plans to do nothing more then try to negotiate some sort of payment from Toyota, so he can take his 50% cut and move on. Judging by the comment that he doesn't have to pay the attorney anything "cost comes out of winning proceeds", this smells like the typical lawyer from pages 1,225 - 1,350 in the yellow pages. My neighbor has been trying this avenue with his 5 year old Ford Exbidition for the past year, with no results other than Ford offering to pay him $1,200 for his troubles while dealing with his leaking front differential. The lawyer immediately turned it down, as $600 bucks doesn't cover costs for him...and the argument continues, with no end in sight. This will be the same result from fadiddy's lawyer, no doubt in my mind. Otherwise, why in the world would you want Toyota to refund your money? You going to give 50% of that to your lawyer? Because that's what he's expecting, and you've agreed to! You get $20k, he gets $20k, and you ain't got no car, but still a remaining balance on your loan. In the mean time, Toyota simply put the car back on the lot!

You better review that contract you've signed with Shaft-Shaft-Finagler attorneys at law! And you better HOPE Toyota doesn't refund your money and take your car. You better hope they offer you some kind of incentive, take it, pay the attorney, and go have a few brews with your friends.

For the record, my vote is that the original poster will not have any luck with his lawsuit.

As previously mentioned, Toyota may offer to buy it back at a "reasonable" value, but the OP will take that hit as well as the attorney fees.
