Well... I got rear ended today, but....

This is more important than the truck. The other driver was at fault so they have to pick up all the expenses you incur. Get checked out now, don’t wait.

X-rays are good for spine problems but an MRI might show something that’s not visible on the x-rays. One w/o the other is bad news, tell you PCP you want both. The other insurance co. has to cover all your medical costs even if nothing turns up.

Definitely will get checked out.

What happens if the other driver tries to argue that they aren't responsible? The person did yell at me blaming me that I caused the accident by stopping. The cop who arrived on scene said that she was 100% responsible, as I was stopping for a person to cross the street, but I still need to wait for insurance to get the report....

I will go see my PCP and get the MRI done. I already did the Xray's at the ER on the day of the accident, but does that mean I should get it done also at my PCP?
 
Definitely totaled - I'd not accept the settlement check upon first offer - take few weeks and haggle for a better buyout price in the meantime. insurance hates dealing with cases that includes a totaled vehicle, they prefer to offer and close quickly to avoid time and effort being wasted

How long should I drag it out for? Is there a point where they will just say it's the final offer? Is there a deadline of how long I can keep dragging it out for? Could I theoretically drag it out for a year and get what I want or much closer to what I want?

First off, I'm sure this is going to sound mean and I don't mean it to come across that way, but you need to quit worrying about your vehicle, and start worrying about yourself. Your vehicle is replaceable. That may be hard for you to hear, but the most important thing is taking care of yourself. 90% of your posts have included something to the effect of "what about my vehicle?". This needs to be the farthest thing from your mind in the immediate time frame. You need to be concerned about your physical well-being.

Secondly, the length of time to file depends on your state. For example, in Idaho, we have up to 2 years to file a lawsuit against the insurance company responsible for ensuring the responsible party. Ymmv. However, any good attorney that you and Liz told be able to tell you what you need to do, as far as doctor's visits, litigation, and other information that will be vital to you and getting yourself taken care of.

Lastly, you need to not be in a hurry. This is the most important thing that you need to remember, aside from getting yourself taken care of. Insurance companies Bank on the fact that you want to get a quick resolution to the problem. This will always work in their favor. You need to take your time, get a qualified attorney, and settle yourself in for the long game. Stop thinking in terms of days and weeks and start thinking in terms of months and maybe even years.

And in case you're wondering, yes I am speaking from experience. Good luck.
 
Damn.. that blows... How often do the cases even get accepted? Could the t4r possibly make it?

About 10 years ago my Porsche got totaled. My insurance offered like $21k but I countered with $27k supporting my case with market value quotes of cars on sale. We eventually agreed on about $25k. I have USAA (they are the best!) who really works with their customers, not sure of other companies.

The person behind you is responsible for keeping a safe following distance regardless of what you are doing. You stopped for a pedestrian who has the right of way, then as you stopped the driver behind you must stop accordingly. She has no case, period. Plus it helps that the police agreed with you, as long as he noted what occurred in the police report.

In complete agreement with outlaw here. Your body and health are foremost and you need to take care of that. You may feel fine right now but issues may arise months from now. Get a good lawyer, research their reputation, sit down with them and describe all details. You may want to start a journal right now and write down everything you remember about the crash, including how you felt afterward. Describe in detail everything you can remember. Don't wait until you go to the lawyer, write it all down now. These notes will be invaluable when you do go to court. Most personal injury lawyers will get you the most money they can get because they will get a portion of that. Get a lawyer that promises no fees until you get your settlement.

As she is, no arguing facts.

Tell your PCP you’re concerned about your back pain and want to make sure everything is covered by a thorough exam. Being sent to PT w/o an MRI is foolish and could make things worse.

Good luck with everything, lawyer up and get a second opinion from another DR. MRI is extremely helpful just keep good documentation!

I'd be wary of any that heavily advertise, or any that are trying to get as much money as possible (for you and for them) out of the other person's insurance. You don't need a huge settlement, just someone to help make sure you are fully compensated for your injuries, medical bills, and damaged vehicle. You probably don't need to take it to court unless you can't get what you deserve from the other person's insurance. But it is probably in their insurance company's best interest to settle out of court, too, to save money. A lawyer will advise you how to proceed here.
 
A lawyer is probably not needed, your insurance company should make sure you’re treated fairly since they’re also protecting themselves. They have a staff of lawyers for that kind of stuff. They will go to great lengths since they don’t want to get stiffed down the line for missing anything the woman’s insurance company is responsible for covering. If things go south you may have to resort to a lawyer. Don’t waste money and complicate things unless you’re forced to.

I went through this same exact thing and my insurance company tried to screw me to the wall...I hired a lawyer got my truck (2011 Limited) replaced with a 2015 Limited with 10K left over, please don't let the insurance company try to settle it my insurance company started with low balling the trucks worth then came the sales tax I paid, lost work, doctors bills no rental, aggravation and so on without him I would of lost my mind

Well you do not find out they are crappy unless you want money back as long as you pay your bill no problem make a claim and the demons come out
and after I got what was owed to me I dropped that insurance company like a bad habit just like they would do to me ***BAM***

Yes you are correct, the vehicle is something that is replaceable. I should care about myself a bit more, but I seriously have no idea what to do. I do have a docs appointment coming soon and hoping to do an MRI/CT scan the same day. So as of now, it's really just a sitting game for that to come up...

Wow, didn't know that. I thought that once the settlement was done, it's done...

Are you serious? Months and years? There's no way I can deal with that.. I'm still a student, and I cant take time off studies to deal with this.. Even though it's her fault, will it seriously take this long?

I have noted everything from then and now.

About the money, Is it a reasonable worry to worry that I may get less or equal value settlement with the lawyer as I could with just settling with insurance?

Agreed. I'm not looking to screw them over and be the guy who's like "screw you, i'm going after everything". I legitimately just want everything covered, now and in the future, especially since i've got a long ways to go still, at 22...

I will go ahead and talk to my lawyer.

Are you sure? I keep reading that even my insurance will try to cut it as low as possible with me, even though they are on my side...

At what point do I know when I'm forced to get a lawyer? I just don't want it to happen where it's too late to get one, or I say/do something wrong
