Bad news for me...but I'm still Lucky

I would let the insurance company do the work. That is why you pay them. I had my Sienna legally parked and it got hit in front of me. I let my insurance do the work for me and eventually got my deductable and everything back.

A lawyer wouldn't be a bad thing to have regardless of the insurance companies.

since my Geico insurrance is not cover the medical cost (including emergency room services - X-ray, phisical therapy etc.), I would have to call the Lawyer up. But I don't know I should go with option 1, and the lawyer as well? Or shoud I go with the lawyer option only?

Since the accident was not your fault, you should not have to pay a single dime out of pocket for repairs or a rental. If your insurance company is trying to make you pay a deductible and for a rental while your 4Runner is being repaired, I'd contact a lawyer, followed by your local press. I'm sure your insurance company would not want to advertise that you pay for repairs regardless of fault.

The only time you pay any deductible is when you are at fault, or something happens when there is no fault, or the other person does not have insurance.
 
I'm sorry. it is my english. I only have to pay for $500 deductible. They gave me the rental for free upto $750.

My Rig is at the Tow lot right now? I will come and pick up all personal belonging and take some pictures and post when I return?

I had a similar situation with Geico too, which which is the reason I left Geico - THEY SUCK!

My 2 cents to you is to inform Geico of the incident, do not make a claim - I repeat, do not make a claim to Geico!!! They will charge you a deductible and raise your coverage.

INSTEAD - Call up Traveller's insurance, they are wonderful to work with. I have them now for my auto and home insurance. Inform Traveller's Insurance that you were hit by one of their customers in an accident, and that the lady that hit you was ticketed. Give Traveller's the police report case number, or better yet, fax it to them. Traveller's insurance will be responsible for fixing your vehicle, or replacing it if it is totalled, as well as covering all your medical expenses, and also will provide coverage for a rental vehicle while your vehicle is being repaired.

This should not cost you anything, you should not have to pay for anything.

After all of this is resolved, I would recommend you drop Geico as your insurance provider. Sure, they have cheap rates, but they suck for customer service and don't do what they are supposed to do. I love Traveller's Insurance, my agent does all the leg work for me. In a case like this, my agent would be doing everything I described above and it wouldn't cost me a cent.

G'luck, ice those muscles too, and then later on put a heating pack on them if they are still sore and tight. Aleve works good for muscle pain too.
 
A few weeks before i got my 4runner, my celica was parked and some kid backed into in while i was walking to it. i had AAA at the time and there was a $500 deductable but i didnt pay a dime because it wasnt my fault so AAA waived it and pursued farmers for the money (the way it should be) the way i look at it; your already paying alot for insurance, make those paper tigers get off there asses and do some work - thats what they are there for...

Dude, that really saddens me to see your truck in that condition. Especially since just a few days ago it looked like this next to mine..

Ouch....That looks like a good bit of damage. The front wheel looks to be at a angle. I am glad you are alright.

I got hit like that once, I decided to go to the doctors just in case, the other insurance company paid for the visit.

As for your insurance, you should not have to pay for anything. Since you have proof that you were not at fault, Travellers insurance will and must cover the cost of everything (including your car repairs, and medical costs and rental etc etc) Nothing should come out of your pocket or your insurance's pocket.

If your insurance will not do anything, I'd drop em in a hurry as it's their job to take care of you. They are suppose to get Travellers to pay you for the damages and medical costs anyway.

If your ins doesn't do their job, I'd get a lawyer in a hurry.

I feel sad...It is just like my baby whom you have been taken good care of. Now all the sudden, it is handicaped...anyway, it is still my baby now.
 
Sorry to hear and see that, Linh. But glad that you are alright. Try to get them totaled it because it seems too much damaged. If you happen to get it fixed, use the "Loss of Value" law to make them pay for it because even though you get it fixed, your 4Runner will NEVER be the same as before.
 
OH MAN! Now that I have seen the pictures, you are LUCKY to be alive. Those are rough to look at. That lady had to be driving fast if yours and her truck looked like that. Hopefully you and your truck will be better soon. Stay well..
 
Glad your okay. The 4runner really held up its end of the collision, even though you had major damaged it still doesn't look as bad as the trooper. This is why I'm glad I have a 4runner.
 
Are any earlier gens worried?

In this type of collision my 2nd Gen would do as follows.

I'm going forward. The lady starts to turn. Her Montero hits my side and both my nonexistant drivers side airbag and my nonexistant door side airbags wouldn't kick in, and I'd end up with whiplash, a bad back and the toyota logo from the steering wheel engraved on my forehead. Ouch...

BTW Linh, I'd try either looking online or calling Travellers. Politely... feck Geico. They're the cheapest cause they'll treat you the cheapest... the only thing good about them IMO is their commercials. Call up Travellers and work with them, they should be responsive. And if that doesn't work, get your lawyer to work with them. I don't think you need a lawyer if Travellers works with you, it'll just be an added expense. GL
