I love it too. It was blue with a black convertable top and the hide away headlights. 327 V8. The impact bent it in the middle . I replaced it with a 1969 Chevelle SS 396 - it had 3 duces and no power steering so my wife could not drive it very well, because she could not downshift and turn a corner at the same time

After the second estimate for further body supension damage, The grand total is up to $17,000 now. It is 60% of the Rig's value, but they decide to fix it instead of getting tollaled.

17K!!! I thought that if it's over half, they total it. I'd suggest selling it as soon as it gets fixed and getting yourself a 2K5

I agree, totaling the vehicle would be better off since it's never going to be the same. Plus the resale value just tanked already anyway...

But I'm sure the ins comp won't agree on that though.

I don't know about VA state laws of how much damage cost is considered as totalled. However, I think it must be at least 2/3 of the vehicle value...

Goodtime, No...the Travelers ins won't consider it as totalled...Otherwise, I would love to get the 2k5 4Runner...however, I will get the lost value claim after fixing it and go a head with the trade in.

Wow...nasty accident! It's good to see everyone survived that OK. Sorry about your truck...it hurts to look at.

I think you can get them to total it if you press the issue. They stand to lose far more if they have to defend this case in court. Their attorney fees alone will be far greater than their additional cost paying a total loss. Make sure your attorney knows you are willing to pursue this 'all the way.' A couple of letters and an initial filing in court should get them to substantially up their offer. The only twist here is the other driver's liability policy limit. Once that threshold is crossed, they will no longer fight. They'll just pay out and walk away. At that point you'll be pursuing the driver directly. That's pretty much a no win situation for you unless she has substantial assets AND you can prove she was grossly negligent or willful.

The longer this drags on the more expensive it gets for them. They will settle for a total loss+ and laugh at how cheaply they got off.
