There is no high sulfur diesel available in the US. In 2011 it was mandated that all diesel fuels in the US be ULSD. Both fuels are the same except for a red dye is added to the off road diesel. That is to mark it for easy identification as it is not taxed. If they catch you running red dyed off road diesel in on road trucks the fines are very serious.

That is the reason for the off road diesel being cheaper than on road diesel, it does not have all the taxes attached to it. There is no difference in the refining or production of the product.

That's probably where I remembered there being a difference. I haven't driven a diesel since 07.

farmers up here do that alot, run red dye in non farm equipment vehicles. its not pretty when they get caught running it in there personal vehicles not related to farm work.

Excellent post JD, thanks for sharing that. Def. a great concise summary of diesel fuel in relation to the US.

As others have stated the red-dye truly is exactly the same as the taxed green tinted fuel. I, like many of you, have heard the nightmare stories of DOT dipping tanks. And also heard various numbers concerning the fines but I'm curious to know if anyone has a source noting the specific penalty incurred if your caught?

FWIW, I Don't even have my truck anymore so I'm not wondering on whether it's worth the risk, it's a subject that comes up every now and again and in all my years perusing the diesel forums I never saw someone actually post the fine sourced from the DOT.

well for ND the state fine is $500 minimum. then you add in the fedeal tax based on the tank volume, then add the federal fine.

Federal law provides that any use of
dyed diesel fuel in a licensed motor
vehicle subjects either the operator
or registered owner of the vehicle to
administrative penalties.

The results of this test will be shared
with the Internal Revenue Service.

This federal penalty is separate and
distinct from the state penalty and
must be treated accordingly.

NOTE: Questions regarding the
federal penalty must be directed to
the Internal Revenue Service.
