Sorry to hear about you wreck. Glad all are OK.

But- If you hit someone in front of you going the same direction, you are at least partly responsible.

You can't assume anything, you can't second guess what the guy you are following is going to do. You should keep enough distance to be able to stop no matter what he does.

I live 10 miles from a Nat'l Park. Folks will do the unexpected at any time. You have to be ready for it. If you hit him, you were following too close.

It's all about defensive driving.

The guy was at fault! He was turning right and at the last second he pulled a U-turn to his left. In that intersection there are NO U-turns allowed or left hand turns allowed.

FYI, the owner of the bodyshop I use once told me that most insurance companies he deals with will total a vehicle when the damage exceeds 70% of the value of the vehicle. Some insurance companies will go closers to 80% depending on the vehicle.

Now-a-days it is not very difficult to run up a fairly large body shop repair bill. Hood, Fender, Bumper, Grill, Frame work, Paint work, New Air Bags can all add up VERY fast.

BTW, from the photos it appears the windshield is not cracked?
If that is true, I find it interesting that an accident did not crack the windshield but small stones do.

The windshield was already cracked from a couple of years ago by a small pebble. There wasn't any additional cracks to the windshield from the impact.

Sorry to hear the news and glad that no one was injured. I do wish you the best of luck with the insurance company. If you're lucky, the other party's insurance co will total the vehicle. My sister's '06 TL (7 months old at the time) was t-boned by a teenage girl who ran a stop sign at a 4-way intersection. My sis bought her loaded TL new for $35,600 otd and the damages came out to be just under $18k (~50% of the car's new value). There was partial frame damage, blown side & curtain airbags, smashed front & rear passenger side door, right rear qtr panel, etc., and the other party's insurance company (Farmers) refused to total the vehicle.

My sis had drove up from L.A. to San Francisco that weekend for a little vacation and the distance was the main reason why we wanted the TL totalled instead of getting it fixed. As it turned out, our ins co (Mercury) and their ins co (Farmers) had a common certified auto repair shop in the bay area (Mike's Auto Body) that did the work. 1st they towed the TL there, then tore it apart to assess the damages, gave us an estimate of $17k. After refusing to total the car, we wanted the car delivered back down here to L.A. for repairs, but they said that it wasn't possible as the car is in pieces. So to make a long story short, car was fixed up there, my sis had to fly back up there to pick up her TL and had to drive back down to L.A. My sis and 2 friends were in the car at the time of the accident and our attorney is still working on the case. Both insurance companies are not being very cooperative. Our ins co (Mercury) doesn't give a shit b/c they aren't picking up the tab and Farmers is dragging their feet. Getting into an accident while you're far from home really, really suck! Sorry for all this ranting and for hijacking this thread. I wish you the best of luck!

ouch, sorry to hear that. at least everyone is ok and not injuried. what insurance company you with? do you think if it is a good idea to have an estimate from Toyota bodyshop? since they will write up a larger bill, and dealer bodyshop always charge a bit higher. hopefully they can pump up the cost a bit and make it close to what the margin of totalling a vehicle. and i think it is your right to choose any bodyshop to fix your vehicle even though claiming insurance. and this case since it is not your fault, your insurance company should fight for you to get full amount since other party's insurance is going to eat whatever it will cost to fix your car/or total the car. just a thought of mine, not sure if it works or not.

Thanks for all the info! The appraiser won't see the car till tomorrow. Hopefully I found out this week in whats going to happen! My insurance is Liberty Mutual and the other guys is State Farm.

The Insurance appraiser finally took a look at my 4runner. Its $13,700 worth of damages and not a total loss. He said there might be another $3k he might of missed. So I had my car towed to my body shop and they are going to go over the car and see if they can find more, that might of been missed.

Some guy was turning right to turn off then at the last second he cranked the wheel to the left and try to make an illegal u-turn at a intersection/backroad. The speedlimit was 55mph and I was traveling 40mph slowing down, light was green so I proceded, then I t- boned his rear drivers quarter panel. Everybody was fine, had my wife and my 11 month old son in the T4r and did not feel much impact. I think my 4runner might be totaled. The guy and his girlfriend apologized and admitted that it was his fault. The guy was complaining that he will lose his license after this. Now I just have to wait and see what the insurance co. will say. I did have two highway patrol officers fill out a report.

The fender was gone, ended up putting that inside the car.

Damn, glad you're all ok. As for the vehicle, make the insurance company buy you a new one. Don't let them fix it- it will never be the same. Sue them if you have to. It is worth it.

the insurance co is making money off of the other party's insurance co. Make sure all parts are OEM. DO NOT ACCEPT Remanufactured stuff PERIOD.

Buy items off of ebay, headlamps and such and put a few pennies back in your pocket.

The body shop found more issues, the Main harness is damaged, headlight harness, windshield is cracked on the bottom corner next to the pilar, the pilar is dinged, rear bumper chipped by tow truck driver by standing on the rear bumper, and possibly more. I should find out more today. The body shop is going to inspect the motor. The top of the motor where the plastic snorkal is cracked. I hope the mechanical issues won't void my warranty. I only have 28k miles on it. I told the body shop to have all mechanical issues fixed by the dealership, so they don't void the warranty. If they were to fix it. Hoping they total it!

If I were you I wouldn't be so passive about this situation. You need to call the insurance company and tell them they need to buy you either a new vehicle or total it out. If not, you need to sue them. You're vehicle will be a piece of junk if they repair it and might even have a branded title because of the repairs. This is more serious than you think. Also, if you ever get in another accident some places or insurance companies won't pay for repairs on vehicles that have branded titles or were previously extensively repaired. Some won't even cover the vehicle. My father sued his own insurance company once because they woudn't total the vehicle although it was 80 percent of blue book value.

The body shop estimate is 15k and not close to total loss. The frame and suspension is not damaged. The insurance appraiser added things that were fine and missed a few things to replace. But I guess I'll have my 4runner back in 2weeks. I'll post pics when I get it back.

make sure really really check on every single thing before take your rig out of the shop, i hate to say it but be as anal as you can. anthing seems not perfect, refuse to pick up the rig. good luck and hope to see her back on the road!

Should have it back end of this week. I did go check it out yesturday and the hood, fenders, grill, radiator, A/C crap, fuse box, battery, and drivers doors, is all fixed and painted. Whats left is the windshield, bumper to be installed, and then goes to Toyota for inspection. Of course I forgot to bring my camera this time.
