Owner shoots bad guys trying to steal 4Runner

I have actually had experts shoot at me with real weapons, they failed. I wish someone would shoot at me as I was shooting them, you only get so many training opportunities.

We have the same law here but I don't think any laws make it mandatory that you kill somebody for stealing a truck. You guys can fire away - I think I will just fill out insurance paperwork instead and save my ammo for serious threats....like anybody on the internet who dares disagree with me. :bounce:

Nope, you sure aren't. Then again, maybe that is why crime has been falling in Houston as more people have been moving in. Then again, I guess you know that.

I don't think I would shoot at someone breaking trying to steal my truck. I would definitely put a few into some one who has entered my home and I feel is a threat to my family. Do I want the guy who steals my stuff punished? Absolutely. To me the punishment doesn't fit the crime here.
I just don't think I could sleep at night having shot someone breaking into a car. For all I know these guys were 35 year old crack heads, leachees on the system, who proably deserved something severe. But what if it was a couple of stupid kids who made a bad decision?
I made a lot of bad decision and now I pay my taxes and contribute to my community. Not sure how I made it this far...

There is a constitutional issue.
I'm not going to comment on the legal issues of this case and I hope that nobody is so foolish as to follow legal advice from an anonymous person on the internet.
That said, I want to point out that the fact pattern of this case, as presented by the original news report, is not as simple as "seeing someone stealing a truck and responding by shooting the would-be thieves." Rather, the news article indicates that the 4Runner owner "confronted" the alleged thieves, during the confrontation believed one of them to have a gun, and then fired his own weapon. The morality of shooting the alleged thieves changed if he perceived that at least one of them had a weapon. The issue is whether he should have confronted them at all or merely called the police.

I had this same quandry a while back when I bought my UTS-15. I had talked to the guys at the counter about places to purchase non-lethal ammunition for use in the shotgun in case I had someone break into my home. They're response was "you're better off killing them, its illegal for civis in California to have non-lethal rounds. Dead men tell no tales." To which I was like, "well so much for being considerate..."
I understand the ridiculous liability of a thief suing you because you shot him. Personally if someone were stealing my truck I would have no qualms about shooting them after giving fair warning. If they decide to pull a weapon on me then I will have no choice in defending myself. I would much rather wound them so the justice system can deal with them (that way if it were someone making a poor choice in life they have a chance to get their **** together.) But like I said earlier, Cali rather you just outright kill them if you feel your life is in danger. God this state has the most asinine gun laws...
Simple matter being, I would rather give you a chance to turn away. But if you come into my house with a weapon or intent to harm my family or I, I will not hesitate to protect my property, family, and life.

§ 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

Well, I think it depends on what twelve people are in the jury more than anything. But, that's the best system we have so......:shrug:
But, I'm glad I live in a state that gives innocent home-owners the benefit of the doubt and doesn't stack the cards against them. It blows my mind that in some states (NY, for instance) it's the homeowner's responsibility to retreat from an intruder if at all possible and they must face that burden of proof.
...except for Houston (Chicago with cowboy hats)....Austin (Madison with cowboy hats)....and Dallas (Los Angeles with cowboy hats).
Face it, there is no big city free of liberal scum these days :shrug:

The Miami area saw two stories of armed citizens protecting themselves Monday night. A homeowner in Miami stopped his house from being robbed by shooting the intruders, killing one. Meanwhile, a gas station clerk in Hollywood, Florida used a gun to stop would-be robbers, killing one suspect.
The homeowner, only identified as a 19-year old male, called 911 when two men tried to break into his house. Shots were exchanged and one suspect died at the scene. The other managed to escape.
The robbers walked into the store, firing their guns. The clerk knew their intentions, grabbed his gun, and started to fire back.
"They were going in with the intent, that, according to the clerk, they came in firing, so they didn't know he was armed," Hollywood Police Sgt. Pablo Vanegas said. "They were coming in to do what they were gonna do."
The clerk hit one suspect, who died at the scene. The second one escaped, but was quickly caught by the police. The clerk was not injured.
Neither had time to wait for the police. They had to act right away if they wanted to survive.

Here's a good one. I watched a Dr. Phil episode with this girl. She seems truly terrified by what happened and by no means is she a trigger-happy redneck. Fact is, there are some evil people out there who like to prey on those who are weaker. This is why we have a second amendment.
