Toyota messed up oil change bad!! Advice

Insurance is NOT going to cover this. They won't even file a claim.

Toyota is NOT going to give you a new engine. Even if you take them to court. They are required to pay you the value of the engine in the state it was before they screwed up.

They may be good and offer to rebuild the engine. Or they may offer a used engine with low miles.

They are NOT required to give you a new engine or new vehicle.

Most of the "advice" that has been given so far probably wouldn't do him much good unless his state laws cover those kind of things.
 
Mine has 140k miles, and it's 10 years old lol. I'm giving them the opportunity to make it right in my mind, and documenting in their system and printing me off hard copies every step.

10 years old and 140K, I'd be ecstatic if they offered me a crate engine under full warranty. If the rest of your truck is in good condition, you'd have yourself an 'almost new' rig that will last another 10/15 years.

Be cool with them, but also make sure they understand that you're ready to consult with a law firm - if you don't end up with a deal that gives you peace of mind.

Wonder how many folks have 'full coverage'... on a 10 year old vehicle ?

I have full coverage on both of our 4Runners…03 & 04 they were both paid for in cash. I wouldn't insure them with anything less.

To the OP think about down the road and how your going to feel about them saying its all good or having a rebuilt engine in it. You don't want to look back and wish you would have handled things differently. Put a lot of thought into all your options, don't settle for anything unless your completely satisfied.

As a matter of fact they will. I had a similar event at a Dealership happen (not Toyota and not on my 4Runner). Adjuster not only came out and priced the cost of repairs (over 4k) but they handled all the paperwork, repairs done at another shop (dealer) and got the costs back from the original dealership's insurance.

The only shitty part was the loss of use payment which was minimal, but everything else covered.

So my friend before you spout off on thing you know nothing about, do a little research.

In my case Progressive was insurance carrier and this happened the spring before last.

In case of no comprehensive coverage well that's tough. However your carrier may still advance the claim on your behalf. The decent mainline companies will, even though they will tell you they themselves have no liability if you don't have the coverage.

My point is you pay for insurance and don't feel hesitant to use it. They will generally just submit your claim to a 3rd party arbitrator between the dealers insurance and yours and it's decided and payment made. That's if the dealers insurance balks. My dealers insurance paid up without too much hassle and Progressive took care of everything.

I was a consultant to the insurance company for YEARS....I'll say with pretty good certainty that you can NOT make a claim..no matter what state you live in. This is car insurance...NOT business insurance. They are totally different animals.
 
when someone unscrewed the old filter, the gasket did not come off with it. someone installed a new filter and now there are two gaskets squashed against one another.

I did this once by accident when I was a kid on my first car and immediately caught it. Boy does oil fly everywhere!

You do enough oil changes over the years....and eventually it'll happen to you. Happened to me more then once. And I noticed it right away. It leaked like a sieve.

It was just an "I'm curious" question.

It's very easy for an ins co to 'total' a car that old even with a minor owner at-fault wreck since it is worth so little.

If the premium, deductible, value of the car, and your driving skill factors work the money equation in your favor, it is certainly OK by me.

But the original question remains and I'll probably try to google it (how many 10 year old cars (percentage), with no lien, and maintain full coverage auto ins?).

It is interesting that full coverage includes oil change disasters as well as 'at fault' wrecks. Learn something every day.

It will never happen to me because I always run my finger across the old gasket to get a little oil on my finger to use to lubricate the new gasket.

My neighbor did it once and his leaked like crazy as well. I would have never expected it to pour out the way it did.

Sorry..never worked in the insurance industry. I worked as a software consultant to the insurance industry for many years designing their rating systems.

OK.....So PROVE me wrong. I'll wait. This could be a LOOOONGGGGG wait.

Runner has been at the dealership since Friday now. I have yet to hear back from them, I let them know that I am not comfortable driving a vehicle that didn't have but maybe 2 quarts of oil in for over 50 miles of driving it. ANd that I believe they need to either buy the vehicle from me at book value, and also cover my tag, title, tax on what I get next, or an engine. He said he understands, and will get in touch with me when they figure out what to do. I have a ton of legal documentation of them admitting on paper and their own system they messed up. I will easily go to the news and blast them if it's not taken care of. As of now they are working with me. I will keep you posted

Sounds like they are making a good faith effort to rectify this situation. I would just sit tight for now, but also not let my guard down.

I know we all joke about calling them stealerships, but there are plenty of honest ones out there still...don't be too demanding until warranted, and I am sure you will come to a satisfactory resolution at the end :)
 
Forget the 'news' or local district atty. Car dealers pump a ton of tax money and ad money into the local economy, plus you run personal risk of being on the receiving end of a lawsuit. In addition the dealer gives special discounts to local movers and shakers.

I'd get your own lawyer on the case if your negotiations break down.
 
I'm just glad to hear they are working with you. Toyota could:

1) buy it from you at market value and perhaps pick up tax/title/docs on next vehicle purchase.

2) provide you extended warranty on current engine up to 250,000 miles or so.

3) replace engine with a new or re-manufactured one.
