Flipped my truck at 65 mph

Remember to double-check the lower ball-joints on it.
I also hope that hit-and-run driver goes to jail.

I took a look at the ones on this last truck, and they seemed fine. Can they be observed for wear visually, or do I have to have the wheel up to try and move it? I'm thinking of buying a truck out of state and driving it back so it will help to be able to inspect them before I do that.
 
I don't know if that's something that can be negotiated, but we'll see I guess. I feel like if they gave me that much, my rates would go up for sure haha

Okay, maybe I don't understand how this works. I haven't heard back from the insurance company yet, but when my motorcycle was stolen it was as simple as a settlement offer for the value of the bike, and then I signed the title over to them and we were done.

I need money from them to replace the truck, but calling them to pay for all other inconveniences, such as replacing it, isn't a negotiation I'm familiar with. Are your pain and suffering insurance claims a separate sort of claim? That wasn't brought up to me by my agent, but they are aware that we have minor injuries and I was told I am cleared to claim medical bills.
 
This is a different type of claim than when your motorcycle was stolen. That falls under comprehensive coverage, and your insurance company was basically covering the value of your bike.

This case is a liability case. The other driver's insurance company (if he has one) is not insuring your vehicle, but rather insuring him against liability for any actions where he causes harm to someone else. As such, his insurance is on the hook for any damages (vehicle loss, time lost, health issues) that you suffered because of the other driver's negligence.

If the other driver has no insurance, then the "uninsured motorist" part of your policy should kick in and cover the same things.

So, yes, you should negotiate all of the expenses associated with recovering from this event. The insurance company may well try to convince you to simply accept payment for their perceived value of your totaled 4runner and call it good, but they actually owe you quite a bit more than that.

I think I would agree with you in not pursuing further charges. I'd avoid that hassle and leave that to the law. Just because he "only" got charged with a misdemeanor doesn't mean they'll slap him with a $100 fine and send him on his way. Most jurisdictions frown heavily on leaving the scene of an accident, and he will not be free of the legal and financial repercussions of this for some time.

You should do both before driving it anywhere. A trustworthy seller should understand and allow you to do it. Fairly easy to check for play. Just need to jack up so tire is an inch or so from ground. Check for play by holding tire in 12 and 6 O'clock positions and trying to move it by pushing with one hand and pulling with the other and vice-versa, as someone observes the BJ's. . Last weekend, just for the heck of it, I looked under friend's 1999 4runner and found a missing cotter pin on driver side ball-joint, so we also went ahead and checked for play.

The play you observe on video is not because of defective ball-joint but because of the nut that had come loose due to absence of cotter pin.

You may also notice safety wire used to secure the rubber boot. According to some posts that's factory work, and to me that's a sound process.
 
To add some personal experience, I was rear ended from behind by a lady who and I quote, "looked into muy purse for a cough drop and didn't know that everyone had stopped." She actually said that to the police, we both had the same insurance. This was 7 months after my fusion in my lower back. I went in and got seen, lots of tests and everything looked good at that time. So after that their insurance called and they paid for the repairs on my vehicle and a lot of money for pain and suffering along with medical over the next year or needed.

Morale - as much as I hate insurance has a value for every single piece of someone's body, never sell your self short. How much money are you out since this happened, aka - loss work, potential future work, rehabilitation, and the trauma of going through that. Yes I was mentally and turned out physically(at this time) good it was traumatic and as anyone can attest it takes a toll. I mean those poor cans of Beer..thats 50.00 right there! (Kidding aside)

But take everything into consideration, if I had to put a value its value of the vehicle + what you put into it + pain & suffering. My value estimae is vehicle covered, medical plus your pain. My experience says this number should be 20k to 50k. I've been unfortunately on both sides of the table with and without lawyers and they all ended up the same. As long as you aren't asking for more than the required insurance coverage of said state (100k insurance and you only ask for 60k your not being out of the realm). Just be careful and rest take it easy.

Ignore most of this if you are going through your insurance co.

The insurance agents wont tell you the various claims exist. They are in business to make money not pay money out so its up to you to fight them. Your insurance co most likely will not argue on your behalf with the other insurance co. That's acting in the capacity of a lawyer.

Its you against the at fault drivers insurance co. As long as you file a clam against the insurance co. of the at fault driver.

It is inconvenient to replace a vehicle (especially clean 3ed gen 4Runners) and you hadn't planned on doing so. You should be compensated for the time and effort because the accident was not your fault as well as a rental.

The insured driver who drove off and not taking upfront responsibility will pay for this!
I'm really feeling your pain. My wife and kids got hit and its been an eye opener to how nasty these insurance companies are. We were lucky nobody required an ambulance.
 
Not to hijack your insurance discussion, but may I ask what fender flares you had on that truck? They look pretty sweet without being obtrusive like the limited flares.

Believe those are a base level flare that came on some 4Runners. I'm in a bus bouncing down a road up on the Slope right now so it's hard to get a good look but......

There's three types of flares. The tiny sr5 ones, those he's sporting, and the limited style.

We are both shaken up from this, I think about it throughout the day and It's very disturbing. The factors that allowed us to escape injury were narrow. It just seems like $20k is a negotiation I'd need a lawyer for.

They are the stock SR5 fender flares, but I painted them black with Rustoleum Truck Bed Liner. Rust-Oleum Automotive 15 oz. Truck Bed Coating Black Spray Paint-248914 - The Home Depot

I primed them first with a couple coats of automotive primer designed to adhere to plastic, then gave them 1.5 coats of this bed liner spray. I had just painted the license plate shroud and was planning on painting the plastic under the front bumper next. As a bed liner this stuff would probably be crap, but it looks nice on exterior trim pieces.

One of the police officers said "well it's probably time for a new car anyway". My wife started crying and told him we had just got it lol.

That 4runner was my first ever 4wd, and my first ever truck for that matter. I got it because I want to play offroad and take it camping. Most people I know would never be excited about buying a 20 year old vehicle. It's interesting to see the contrast in thinking between an "enthusiast" and a regular person who doesn't view cars as a hobby.

I didn't have a lawyer for when I was rear-ended so I went higher than I got but anticipated a counter. They said a number and I said my number and said they would have to get back to me. We settled on a number with out a lawyer, was it worth it - Not with what I'm dealing with now but it may be just coincidence but at the time it was more than adequate.

Focus on you both for healing, don't skimp on it its always difficult. Where I flipped I still get the cold chill when I drive by it and I'm still affected. A lawyer is cheap in the regards to making sure your protected and TAKEN care of.

For my son and I to assist in healing and moving on, we talk about it (still) and also purchased a vehicle to help. We both really miss the vehicle, still do to this day, but I love my 4Runner :)

PS - The flip over accident DID involve a lawyer.

I do this for a living, for what that's worth. You have no idea what's fair until you have a complete understanding of what you injured and how it is going to impact you going forward. "My neck hurts" could be a muscle strain, a herniated disc, or a facet capsule injury, to name the 3 most common ones. Each can present with similar symptoms or markedly different symptoms, they can be treated differently, and each can have very different long-term outcomes/implications. Until you know what you hurt, how to treat it, and what it's going to cost to treat, you are gambling.

If something is bothering you (I don't say hurt because everyone wants to be macho and say they aren't hurt) go get checked out. That "bother" can turn into "I was in a car accident and I've never been the same" in a few years. If you aren't sure about what your rights are in a car accident, go talk to a lawyer. Remember, talking doesn't obligate you to do anything other than hopefully listen and learn something. You aren't "the type of guy who sues people" because you got your questions answered.

Remember - you've no doubt heard a story about someone who knew someone who talked to someone who heard a story about someone who had a lawsuit/claim/whatever they want to call it, wasn't hurt, and got a big sum of money. No they didn't.

I flipped mine head or tail 3 times, I was unhurt. I still miss my rig,but I bought another exactly the same. New one has bumpers,lift, and roof rack. Just glad you both are ok and able to build the next "sweetest" ride.

I've been looking for trucks in multiple states and there are some very clean examples in Chicago right now. If the insurance company gives me what I paid, I may fly out there and drive one back 1,900 miles to phoenix. I'm hoping that happens because I'll honestly end up with a nicer truck.
