I say no harm, no foul if you keep the money local - head on over to Crave in C. Rock and blow it all on absurd burgers and adult milkshakes.

Young family, another baby on the way - I can't act like I'm not gonna cash the shit outa that check when it comes.

right on. between that and this:

it has me doing this: :ybrick:
? I think I may have been too vague.... I meant "amazed" in regards too how little the price has increased over 14 years as my SR5 with the same moon roof leather options was listed at $34k. Now throw in all that was improved from two gens later..safety/ride/audio/ capability and style... I think the TE is a great price. ? No need to be a hater, I come in peace lol

not hating! sorry if it wasn't clear... what i was lamely trying to express is that on the one hand you have folks complaining about Toyota "cheaping out", de-contenting, or removing features from new models, and on the other hand you have the fact that prices have remained flat (more or less) for more than a decade—as you pointed out. very rarely does it seem that one considers the relationship between the two.

i'm with you: the 4Runner is—still—an excellent value.

I agree that the lawsuit was bullshit. I don't remember filling anything out as I don't agree with it. Still got my check in the mail. I cashed it because I figure that any funds left over would go to the lawyers.

Ok, I was actually confused, and thought this was the 2014 thread I posted on... I failed to check my notification alert as to my comment jumping to this thread...I have no dog in this fight lol... No worries here... be well...

oh, please do tell about your first-hand experience of Sudden Unintended Acceleration with your 4Runner. :flypig:

Setting aside personal opinions of class actions... this suit was not about having experienced unintended acceleration. This was about the public perception that Toyota may have that problem affected potential resale values. In other words, even if you never actually had a problem (or if there never was an actual problem), the damage to Toyota's reputation made private buyers hesitant and thus lowered resale values.

That is likely true for some years, some models, at some point in time. As to the 5th gen? i'm far from convinced. I purchased mine after the "problem" was known, so I likely already paid the lowered resale price, which made my decision about the claim pretty easy.

If you got a check then you filled out and submitted the claim form. Not submitting a form means you waive participation (but not object) and get no check.

The lawyers are paid a set amount; cashing your check does not increase or decrease that amount. Leftover funds are distributed in an agreed way - either a) to other claimaints, b) to Toyota for fees and costs, or c) to some education program fund.

Of course, you always have the option of cashing the check and doing something good with it. Maybe make a donation to a preferred charity or organization. It may not be an ideal situation, but you can still make the best of it.

if you got a check.... you signed up for it

as did i. and i was well aware at the time of purchase (march 2010) that dealers were truly dealing due to all of Toyota's bad press in the preceding months. pretty sure i got my personal "settlement" in the form of a reduced purchase price way back when.

that's all i have to say about Sudden Unintended Acceleration, yo. i'm Audi 5000... :zoom:

I received some class action lawsuit against Bank of America. Settlement amount was already done. The check I'd get was dependent upon how many other people applied for it. I imagine it is the same thing for this settlement. Cashing the check doesn't cost Toyota a penny. Not cashing it means you lose out on $125!

I am amazed by all the LAME excuses to take $125.00 that was neither earned, nor entitled to from any damages.

My information came from reading this specific settlement agreement. The BofA agreement may have had different terms.

I normally let the mail pile up, and I dont remember this but I hope I did sign up and that I do get a check.......come on guys.....are we back in middle school.......prices are going up regardless of this pay out.....I also agree that the payout is the same if 50 people or 5,000 signed up......not signing up based on principal is as pointless as those that dont flush the toilet after a piss and wait till there is a floater in the bowl.....bottom line.....it doesn't make a difference...

so now lets agree to disagree and not get all bent out of shape

I am amazed by all the efforts to express moral superiority.

Same here.

Settlements like this are how these big companies buy off their customers and in many cases, get away without admitting guilt for doing something wrong, and relieve themselves from as much potential future liability--for the same issue--as possible. In other words, they pay them to forget about it. Cheaply, whenever possible. And believe me, it was a helluva lot cheaper for Toyota to respond to a class action lawsuit than to try to deal with and afford thousands of individual lawsuits in a incredibly expensive, tedious process that could likely be dragged out for many, many years. A process that could potentially bankrupt the company.

Regardless, when you agree to accept payment from a class action settlement, you are also agreeing to have no future claim against the sued entity for the same issue. So, if you accept the $125.00 you have no further recourse against Toyota should you happen to experience the sudden acceleration phenomenon yourself, and/or if you or your loved ones get injured or killed due to a result of such experience. But if you don't accept the money, you can sue Toyota again. For the same thing.

Look, Toyota denied the problem existed and refused to do anything about it until a bunch of people sued them and our government jumped in to hold them accountable. And there were actual incidences involving sudden acceleration.

Personally, if I still owned one of the affected vehicles or had doubts that the problem was fixed, or just doubts about Toyota in general, I'd pass on the $125 just so I'd have options in the future. On the other hand, if I felt comfortable taking the $125 and releasing Toyota of all liability. I'd do it.

Somebody was greedy. So what. Toyota lied to us, didn't want to do anything about it, tried to cover it up, and now they have to pay for their f-up.

Enjoy your $125.00.

Stifler, get a life.
