Settlements like this are how these big companies buy off their customers and in many cases, get away without admitting guilt for doing something wrong, and relieve themselves from as much potential future liability--for the same issue--as possible. In other words, they pay them to forget about it. Cheaply, whenever possible. And believe me, it was a helluva lot cheaper for Toyota to respond to a class action lawsuit than to try to deal with and afford thousands of individual lawsuits in a incredibly expensive, tedious process that could likely be dragged out for many, many years. A process that could potentially bankrupt the company.
Regardless, when you agree to accept payment from a class action settlement, you are also agreeing to have no future claim against the sued entity for the same issue. So, if you accept the $125.00 you have no further recourse against Toyota should you happen to experience the sudden acceleration phenomenon yourself, and/or if you or your loved ones get injured or killed due to a result of such experience. But if you don't accept the money, you can sue Toyota again. For the same thing.
Look, Toyota denied the problem existed and refused to do anything about it until a bunch of people sued them and our government jumped in to hold them accountable. And there
were actual incidences involving sudden acceleration.
Personally, if I still owned one of the affected vehicles or had doubts that the problem was fixed, or just doubts about Toyota in general, I'd pass on the $125 just so I'd have options in the future. On the other hand, if I felt comfortable taking the $125 and releasing Toyota of all liability. I'd do it.
Somebody was greedy. So what. Toyota lied to us, didn't want to do anything about it, tried to cover it up, and now they have to pay for their f-up.
