Barring a pileup where you are thrown into the car in front, it's pretty much on you 100% if you rear end someone.
Besides, I fail to see how a tow hitch is going to cause any more damage than without. If anything, it seems to cause less damage to both parties.
In any event, I cannot see it as a danger. It is not illegal. It isn't unsafe and clearly seen since it has a shiney chrome ball on it. Looks goofy, tho.
btw, I usually don't go in for exhaust tips or bling bling but that valor tip looks really good on the truck!

This is kind of blown out of proportion. He has a tow hitch on his truck. It's upsidedown. Big deal. What's the difference between his tow hitch and when I have a hitch bike rack on my truck?
I agree with you that dangerous attachements are not good but I don't see anything illegal here.

Rather than take out people legs, I'd rather have something more discreet that still offers protection from careless morons in parking lots, etc. like a hitch step:
