I wouldn't go that far. Judging by the damage on the BMW, it looks like the impact was all on the passenger side of the bumper and not on your hitch. Further, it looks like the bumper and frame rails of the BMW went under your truck and the tailgate damage was from the fender/hood that kinda wrapped around your bumper, because all that stuff above the bumper on the BMW is pretty squishy. So, bumper went under and sheet metal went over. If it gets totalled out (probably won't) you could buy it back, replace the tailgate and bumper and be good to go. I doubt the frame is tweaked. She didn't have to hit your hard to do that damage to her car.
My wife got rear-ended in our 4runner a few years ago and they hit dead center on the hitch and bumper. Bumper was scratched, hitch was unfazed. Other car was MAULED on the front end. Radiator was trashed, hood and bumper trashed, radiator core support tweaked in a major way. Their Accord needed $2-3k in work to be right again and our 4Runner got a new bumper and had a dent on the tailgate removed. The dent on the tailgate was already there before the accident, but the body shop said, "We can fix it and just bill their insurance for it. No way they could say it wasn't from this accident."

How does your rear body panel and floor look? With the hatch pushed in that far you might want to see if the impact energy carried into those areas or were impacted from the hatch itself. Check the gaps around the hatch, it might show the hinges flexed some. Any quarter damage?

Maybe to give you some hope I had hail damage all over the horizontal sheetmetal and my insurance company gave me a check for 3700 bux and didn't total my truck and mine is older and has 180k miles on it. All I did was buy a new hood and called it good since the damage is really only noticeable on the roof and isn't that bad.
But yours may depend solely on the frame being ok but the rest should be easily fixable.

This is a borderline total loss, based on 70% of market value (parts and labor) being exceeded. The other insurance company will not force you to do anything. You can take a repair cost check and do what you wish. I'd definitely keep your rig, it's too nice of shape. There is likely damage that we cannot see including the bent exhaust system, bumper absorption parts, and body panels connected to the bumper and behind the tail gate. Maybe you can upload a few more pics of those areas. Regardless, sorry to see your bad luck here.
A couple weeks ago I had a minor mishap with my daily driver, a 96 Grand Cherokee. Just this was over $2100 in damage and was considered a total loss. I opted to let it go verses repairing it.

So this was AA county on Bestgate Rd. And the lady had just driven it off the lot 10 minutes earlier. I can't get the tailgate open so we'll find out when the appraise it tomorrow and will report back.
The wife says just get 'another car' as if there is anything I would want in place of. Got me thinking and the only suitable replacement would be a new FJ Cruiser or a Touareg TDI.

Id either start looking for another 3rd gen or maybe a Land Cruiser. Im pretty sold on Toyota/Lexus products so not much else Id consider.

If my rig was to disappear tomorrow, beside my comment above
I would have a hard time not wanting to find another, for me it would be especially bad because I'm just not an automatic fan. I was so lucky to get what I currently drive, it was the first runner I looked at, it's not perfect by any means but was so easy to find, no more then 10 miles away at a used car lot and the owner of the lot was ready to unload it because soccer moms don't want a manual.
I would probably go and get a cheap dual sport (summer time) and save, save, save till I found another runner. Then I'd kick myself in the ass for selling my 86' runner 4 months ago. And yes, I'm doing that already just because I sold her, I never should have gotten rid of it.
I would be hard pressed to not want another toyota, and would love to get another Tacoma, but they are amazingly expensive here in Oregon.

First off my condolences. The love we have for our rigs is a blessing and a curse, and it's hard to explain to those who don't get it and say "cool you can go buy a new car!"
I didn't read the 3 pages of replies but I'd say insurance will total it out. Just as a comparison I stumbled on this t4r on craigslist today. Don't know the whole story but they are claiming it was totaled due to the rear end damage that appears on the surface much less than yours.

Again who knows the real story of that one, and different insurance companies have different thresholds for totaling a vehicle.
If they do, I'd retain possession and use the payout to put it back together. If you find the right parts for cheap you could come out ahead and put some upgrades into it with the left over.

PNW thats interesting in that link. What a body guy told me was that is the panel above the bumper is damaged it's totaled since that is thousands to cut out and replace. on the link you can see a dent on the panel above the bumper but no clear photo of the right side. Mine has no damage to the (1/4 panel so fingers crossed, they are coming tomorrow to estimate. I decided I'm gonna keep it either way. Went and drove a TDI Touareg today and man it's nice and should be by the price tag...

Honestly, I'd go for a newer vehicle and maybe keep this one for off-roading or otherwise hooning. If you don't do some hard off-roading, then getting something with a modern active AWD system (not sure what the Touregs have) will kick the crap out of straight 4WD. Does Maryland get alot of snow? If you get snow, then stability control is way better.
It's always sad to see one of these go, but you'll probably come out ahead in the end, so it's kind of the last gift your rig can give you, a bigger pay out than it's really worth. It's like your deceased wife leaving you a note that she wants you to be happy and re-marry.

i got rear ended a couple of months ago and the obvious visual damage was much less than what you have, and the insurance co took the estimate for $2900, now i put that into a rear bumper and didnt touch anything other than replacing the bumper. so im gonna guess your very close to a total. but every insurance company is different so who knows. the problem with being rear ended in a 3rd gen is the bumper is attached to the body, not the frame, so when they get bent up they tend to crumple up the flooring in the cargo area and do a lot of hidden damage
The verdict is in I'm keeping it. Insurance found a used tailgate and aftermarket bumper cover, total repair damages $2700 which is surprising to me. I'm sure the body shop will find a little more especially since she said there was room. would have had to be at least $4950 in damages for a total. They added in time to attach medallions on the back and we'll be leaving them off so that goes in my pocket. Needless to say I'm happy about this...
